Privacy policy

This privacy statement covers the website according to art. 13 of the Italian law n. 196 of June 30th 2003 (Privacy Code). FI.MO.TEC. S.p.A. (FIMOTEC), as data controller, informs the users (people concerned) of the website (Website) that by visiting the Website, both non-identification data, i.e. data that does not consent to personally identify the person concerned, and identification data, i.e. data that consents the identification of the person concerned, may be collected.

FIMOTEC is committed to protect the privacy of site visitors, prospects and customers.

The purpose of this policy is to explain the types of information that are obtained from people via the Website, how the information is obtained, how it is used, how it may be obtained by others, and how its use and disclosure can be restricted.

Data that does not consent personal identification

FIMOTEC reminds the people concerned that the internet is a supranational network of computers and other devices whose different components are managed by an undetermined numbers of subjects worldwide; to identify these subjects a priori is not possible.

Nevertheless FIMOTEC warns the users that, when visiting this Website, data which does not consent to personally identify the person concerned are automatically collected.

FIMOTEC automatically collects and stores on its servers anonymous information related to the “Uniform Resource Locator” (URL) of the internet website previously visited by the person concerned; information on the Website pages visited, on the exit page URL, on browser type, on the user’s internet protocol address (IP) and information related to “cookies”.

“Cookies” will be used to collect information whenever the user’s browser has accessed to the Website. A “cookie” is an alphanumeric identifier that is automatically transferred on the user’s pc through the web browser and saved on the user’s hard disk. The cookie file allows to recognize the user’s computer each time the user visits the Website. Most of the browsers allow to notify every new cookie received or to disable them.

FIMOTEC recommends to enable the cookies so to take the full advantages of the Website.

Data that consents personal identification

FIMOTEC informs that personal information may be collected using specific forms on the Website for the following purposes:

a) to process pre-sales requests or to finalize agreements;

b) to send information regarding product updates or other business information;

c) for marketing purposes and promotional/advertising purposes.

With reference to the above letter a) the personal information collected are necessary and mandatory and in accordance to art. 24 lett. b) of Italian law no. 196/03, it is not requested a previous consent of the person concerned.

With reference to the above letters b) and c) the data collected are necessary and the person concerned has to authorize the treatment and communication by selecting the related option in the online form of the Website, if any.

In the event that the person concerned does not authorize the treatment of his personal data, and if in case a) the user refuses to consent the treatment of his data, FIMOTEC will not treat any data and will not be able neither to satisfy any commercial requests, nor to proceed with pre-sales negotiations or to execute agreements.

FIMOTEC guarantees that the personal data treatment does not cause any detriment to the user’s rights and freedom and that the Website will not be used to collect sensitive personal data.

The treatment may involved, in accordance to law limits and conditions, one or more of the following operations, performed with the support of electronic and information tools:

- gathering, registration, organization, maintenance, elaboration, modification, selection, extraction, comparison, use, interconnection, block, communication, circulation, deletion, destruction.

- FIMOTEC informs that the personal data collected with data treatment authorization may be shared with the following subjects:


- FIMOTEC’s distributors;

- FIMOTEC’s sales agents;

- Parent companies, subsidiaries or affiliated companies, including those ones under indirect control;

- Couriers, forwarders and any other subject dealing with correspondence shipping.

By authorizing the data treatment, the person concerned automatically accepts the above circulation. In the event that the user does not want to share his personal data with the above subjects, the user should deny his consent to data treatment.

Rights of the user

With reference to personal data treatment, the person concerned has the right to claim to the data controller the following rights in accordance with art.7 of the Privacy Code, and in particular:

1) The user has the right to get to know about the existence, or not, of any of his personal data, even if not registered, and has the right to obtain communication of his data in an intelligible way.

2) The user has the right to obtain information about:

a) Origin of personal data

b) Treatment purposes and conditions

c) basic logic used, if data is treated with electronics tools.

d) Details of the data controller, of the data manager and of the designated representative in accordance with art. 5, para. 2;

e) Subjects or category of subjects with whom personal data may be shared or subjects who may be informed in their quality of designated country representative or data manager.

3) The user has the right to obtain:

a) Update, correction or integration of his data

b) Deletion, change into anonymous form or block of the personal data treated in violation of the law, including that data that does not have to be preserved in relation to the purposes for which they had been collected or subsequently treated.

c) Attestation that the above operations a) and b) have been shared with those subjects to whom the data had been communicated or circulated, with the exception of those cases when it is impossible to proceed so or when the communication requires disproportionate efforts if compared to the rights’ safeguard.

4) The user has the right to oppose, totally or partially:

a) The treatment of his personal data for rightful reasons, even if data is related to the purpose of collection

b) The treatment of his personal data for advertising, direct sales, market research o commercial communication purposes.
